These Terms of Service ("Terms") govern your use of the linkeden.click website and any estimate, quote, project agreement, or service provided by Atrium Glassworks ("we," "us," "our"), owned and operated by Melissa Ortiz. By using our website or engaging our services, you agree to these Terms.
1. Acceptance of Terms
By submitting a contact form, requesting an estimate, or engaging Atrium Glassworks for services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Description of Services
Atrium Glassworks provides custom glass atrium additions, structural skylights, four-season sunrooms, glass wall systems, structural engineering review, and related glazing repair and reseal services in Salt Lake City, UT and the surrounding Wasatch Front. Website content, pricing ranges, and portfolio images are for general informational purposes; final project scope and pricing are established in a signed written project agreement following a site visit and structural review.
3. Estimates & Project Agreements
Estimates provided through the website or an initial consultation are non-binding until formalized in a signed project agreement specifying scope, materials, engineering requirements, timeline, and price. Prices shown on this website are typical starting ranges only and do not constitute a binding quote.
4. Payment & Deposit Terms
Projects generally require a deposit (typically 30-50% of project total) prior to engineering, permitting, and material ordering, with the balance due per a milestone schedule specified in the project agreement. Late payments may be subject to a service charge as disclosed in the project agreement.
5. Cancellation & Refund Policy
Clients may cancel a scheduled project with at least 48 hours' notice prior to the scheduled start date for a full refund of any deposit not yet applied to engineering, permitting, or custom-ordered materials. Once engineering drawings have been stamped, permits filed, or custom glass and framing ordered, deposits become non-refundable to the extent they cover work and materials already committed. This policy reflects standard practice for custom, engineered glass structures; U.S. law does not provide a statutory withdrawal period for custom-fabricated construction work of this kind.
6. Permitting & Scheduling
Atrium Glassworks manages permit applications with the applicable city or county building department on the client's behalf. Project timelines are estimates and may be affected by permit review times, material availability, weather, site conditions, or change orders. We will communicate any material delays promptly.
7. Change Orders
Any changes to project scope, materials, or engineered design after the project agreement is signed must be documented in writing and may affect price, permitting, and timeline.
8. Warranty
Atrium Glassworks warrants its structural workmanship against defects for a period of ten (10) years from project completion, covering framing, glazing seals, and structural integrity, excluding damage from acts of nature beyond design load, misuse, or unauthorized third-party modification. Manufacturer warranties on glass units and hardware, where applicable, are passed through to the client.
9. Intellectual Property
Design layouts, structural drawings, and custom engineering created by Atrium Glassworks remain our intellectual property unless otherwise agreed in writing. Photographs of completed projects may be used in our portfolio, website, and marketing materials unless the client requests otherwise in writing prior to project completion.
10. Limitation of Liability
To the maximum extent permitted by law, Atrium Glassworks' total liability for any claim arising from our services shall not exceed the total amount paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
11. Insurance & Licensing
Atrium Glassworks maintains general liability insurance and operates under UT Contractor License #9284561-5501. Certificates of insurance and license verification are available upon request.
12. Governing Law & Venue
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute arising from these Terms or our services shall be resolved in the state or federal courts located in Salt Lake County, Utah.
13. Dispute Resolution
Before pursuing formal legal action, both parties agree to attempt good-faith resolution through direct negotiation. If unresolved within 30 days, either party may pursue mediation or applicable legal remedies in Salt Lake County, Utah.
14. Website Use
Content on linkeden.click is provided "as is" for informational purposes. You agree not to misuse the website, attempt unauthorized access, or use it for unlawful purposes.
15. Changes to These Terms
We may revise these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of our website or services after changes constitutes acceptance.
